Terms of Service | Acceptable Use Policy

  • 1.) Account Setup
  • We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.
  • 2.) Content
  • All services provided by us may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, pornography.
    • Some examples of unacceptable material:
    • IRC Bots
    • Warez Sites
    • Pirated Software
    • Hate sites
    • Hack programs and archives
  • 3.) Zero Tolerance Spam Policy
  • We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and “double optin” will be treated as spam. Any user who sends out spam will have their account terminated without notice.
  • We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserve the right to make any such modifications in an emergency at our sole discretion.
  • We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of RubyRingTechnologies.com.
  • 4.) Payment Information
  • You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify RubyRingTechnologies.com of your desire to cancel any or all services received, those services will be billed on a recurring basis.
  • We reserve the right to change the monthly payment amount and any other charges at anytime.
  • If your recurring billing fails, we will attempt to bill every other day for a maximum of 3 tries. We will then make an attempt to contact you via e-mail. If we do not receive a reply within 48 hours (or the e-mail is no longer active), your account will be automatically suspended and your website and e-mail immediately shut down. If there is no response within 14 days of suspension, your website will be irrevocably deleted and your account will be terminated.
  • A reinstatement charge of $4.95 will apply to remove a suspension within the 14 day grace period.
  • Dedicated Servers can be charged a $50 reactivation fee if server is shut down for lack of payment.
  • 5.) Backups and Data Loss
  • Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. We do provide and use daily backups of all files and databases on our Shared Accounts ONLY. However we cannot, and will not, be held responsible if a problem happens between Shared-Server-backups that may or may not cause data loss.
  • Dedicated Servers and VPS accounts are NOT backed up. We do backup the core VPS machines, but your data is your data, and it is up to you to back this up. If you need a backup solution we can provide you with one, but out of the box, these products are NOT backed up.
  • 6.) Cancellations, Terminations and Refunds
  • We reserve the right to cancel the account at any time if we find your website in violation of the rules above.
  • Customers may cancel at any time. Cancellation requests must arrive no later than (3) Business Days before billing. Any cancellation after that will not be processed, and you will be billed for the next month.
  • Since a website can serve a purpose in a short amount of time, we feel it is understandable that there are no refunds for service or hosting at any time.
  • For customers pre-paying for more than one month, you will be refunded for all unused whole months.
  • 7.) Resource Usage
  • Users may not initiate the following:
    • a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
    • b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
    • c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
    • d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
    • e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
  • If your site is found to be the cause of a server overload, we have the right to do any and or all of the following.
  • Terminate your account right away with no warning.
  • Suspend your account until the error is resolved.
  • Fine you up to $250 per file per hour to resolve the problem.
  • 8.) Bandwidth Usage
  • You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
  • 9.) Price Change
  • The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on our site, and the right to increase the amount of resources given to plans at any time.
  • 10.) Indemnification
  • Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from RubyRingTechnologies.com’s server.
  • 11.) Disclaimer
  • We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.
  • THESE SERVICES ARE PROVIDED “AS IS” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL EMERALD VISIONS, CORP. dba RUBY RING TECHNOLOGIES OR ITS EMPLOYEES, OFFICERS, DIRECTORS, CONTRACTORS, OR ASSOCIATES, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THESE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
  • 12.) Free Web Site Hosting
  • Free Site Hosting comes with a AS IS warranty. We DO NOT backup the data on these accounts, because of the account being a free account it is the responsibility of the client to backup and track there data. We do provide tools to easily do this. The free hosting plan must follow the same rules as our paid customers. We reserve the right to cancel, close, and terminate any accounts for not following the above rules.
  • 13.) Changes to the TOS
  • We reserve the right to revise its policies at any time without notice.
  • 14.) Free or Trial Hosting Offers.
  • If you are offered a Free or Trial service, you must follow to the extent of the offer what is asked or offered. For example, some of our offers involve at the end of X days or X months a professional review is to be given. Some offers involve ad space on your current website, others involve a reduced price to continue. You are responsible to review and understand these rules and requirements before excepting any and all offers.
  • 15.) Validation of the TOS
  • Due to the relatively unlimited uses of any of our packages, Ruby Ring Technologies reserves the right at any time, to audit the use of any account on any of our servers. This is not only done to enforce our Terms of Service Agreement and protect ourselves, but to protect you as our customer from possible unauthorized access and usage of your account. We will always do our best to respect your right of privacy, but auditing for TOS Compliance is the held privilege of the Web Host. Auditing may include and is not limited to, root access priviledges to a dedicated server or space, monitoring of e-mail usage, and monitoring of website content.
